| Rada Dyrektorów Allegro.eu ("Spółka", "Allegro.eu") niniejszym zawiadamia, że w dniu 28 stycznia 2026 r. powzięła wiadomość o doręczeniu w dniu 28 stycznia 2026 r. Allegro sp. z o.o. ("Allegro PL") postanowienia Sądu Okręgowego w Warszawie z dnia 26 stycznia 2026 r. w przedmiocie udzielenia zabezpieczenia na rzecz Fundacji Forum Konsumentów z siedzibą w Warszawie (“Postanowienie”): 1) zakazującego Allegro PL, na czas trwania postępowania sądowego, wyświetlania w procesie zakupowym „na stronie www.allegro.pl/transakcja/[unikalne ID zamówienia]/zamowienie lub odpowiedniku tej strony w aplikacji Allegro, na którą przenoszony jest użytkownik po wybraniu opcji „Dostawa i Płatność" (...) niekompletnej listy metod dostawy udostępnionych przez sprzedającego, oraz domyślnego oznaczania i wyróżniania w jakikolwiek sposób, jakiejkolwiek metody dostawy udostępnionej przez sprzedającego, którego oferty objęte są usługą < oraz 2) nakazującego Allegro PL, na czas trwania postępowania sądowego, wyświetlania w procesie zakupowym „na stronie www.allegro.pl/transakcja/[unikalne ID zamówienia]/zamowienie lub odpowiedniku tej strony w aplikacji Allegro, na którą przenoszony jest użytkownik po wybraniu opcji „Dostawa i Płatność" (...) wszystkich metod dostaw udostępnionych przez sprzedającego, którego oferty objęte są usługą < Allegro PL przysługuje prawo do złożenia zażalenia na Postanowienie do Sądu Apelacyjnego w Warszawie w terminie tygodnia. Sąd wyznaczył Fundacji Forum Konsumentów dwa tygodnie (od dnia doręczenia odpisu Postanowienia) na złożenie pozwu w tej sprawie pod rygorem upadku zabezpieczenia. Sąd zagroził Allegro PL nakazaniem zapłaty na rzecz Fundacji Forum Konsumentów sumy pieniężnej za naruszenie obowiązków wskazanych w punktach 1) i 2) powyżej. Fundacja Forum Konsumentów z siedzibą w Warszawie nie kontaktowała się z Allegro PL przed złożeniem wniosku o udzielenie zabezpieczenia. Samo Postanowienie zostało również wydane bez wysłuchania Allegro PL. Allegro PL nie miała do tej pory możliwości przedstawienia swojego stanowiska. Allegro PL kategorycznie nie zgadza się z treścią Postanowienia, które w ocenie Allegro PL jest całkowicie bezpodstawne i podejmie kroki zmierzające do jego uchylenia w całości. Allegro PL udostępnia w procesie zakupowym prezentację metod dostaw, która jest zgodna z przepisami prawa i odpowiada potrzebom klienta, co potwierdzają prowadzone przez Allegro PL badania satysfakcji klienta. Podejście to jest również zgodne z funkcjonującymi standardami rynkowymi stosowanymi powszechnie przez innych uczestników rynku. Opisywane funkcjonalności upraszczają proces zakupowy, jednocześnie zapewniając klientom pełną możliwość podjęcia swobodnej decyzji o wyborze metody dostawy. Allegro.eu wskazuje, że na moment publikacji niniejszego raportu bieżącego Postanowienie podlega wykonaniu, ale nie jest prawomocne. Postanowienie stanie się prawomocne dopiero w przypadku braku wniesienia ww. zażalenia albo w przypadku oddalenia zażalenia przez Sąd Apelacyjny. Zabezpieczenie upadnie w przypadku niewniesienia pozwu w wymaganym terminie przez Fundację Forum Konsumentów. Allegro.eu poinformuje o kolejnych istotnych etapach postępowania w drodze odrębnych raportów bieżących. | Current Report No. 3/2026 January 29, 2026 Subject: Delivery to Allegro sp. z o.o. of an order from the District Court in Warsaw granting preliminary injunction in favor of the Forum Konsumentów Foundation with its registered office in Warsaw Legal Basis: Art. 17 MAR – confidential information The Board of Directors of Allegro.eu ("Company", "Allegro.eu") hereby informs that on January 28, 2026, it received notice of the service on 28 January 2026 on Allegro sp. z o.o. ("Allegro PL") of an order of the District Court in Warsaw dated January 26, 2026, concerning the granting of preliminary injunction in favor of the Forum Konsumentów Foundation with its registered office in Warsaw ("Order"): 1. prohibiting Allegro PL, for the duration of the court proceedings, from displaying in the purchasing process “on the website www.allegro.pl/transakcja/[unique order ID]/zamowienie or the equivalent of this page in the Allegro application, to which the user is transferred after selecting the option "Delivery and Payment" (...) an incomplete list of delivery methods made available by the seller, and from defaulting and highlighting in any way, any delivery method made available by the seller whose offers are covered by the < and 2. ordering Allegro PL, for the duration of the proceedings, to display in the purchasing process “on the website www.allegro.pl/transakcja/[unique order ID]/zamowienie or the equivalent of this page in the Allegro application, to which the user is transferred after selecting the option "Delivery and Payment" (...)all delivery methods made available by the seller whose offers are covered by the < Allegro PL has the right to appeal the Order with the Court of Appeal in Warsaw within one week from the day of the Order’s delivery. The Court has given the Forum Konsumentów Foundation two weeks to file a lawsuit in this matter, under pain of the security lapsing. The Court has threatened Allegro PL with ordering it to pay a financial penalty to the Forum Konsumentów Foundation for violating the obligations referred to in points 1) and 2) above. The Forum Konsumentów Foundation with its registered office in Warsaw did not contact Allegro PL before filing the application for preliminary injunction. The Order itself was also issued without Allegro PL being heard. Allegro PL has not yet had the opportunity to present its position. Allegro PL categorically disagrees with the content of the Decision, which in Allegro PL’s view is entirely groundless, and will take steps to have it overturned in its entirety. Allegro PL provides a presentation of delivery methods in the purchasing process that complies with legal regulations and meets customer needs, as confirmed by customer satisfaction surveys conducted by Allegro PL. This approach is also consistent with the market standards commonly applied by other market participants. The described functionalities simplify the purchasing process, whilst still ensuring customers have the full opportunity to make a free decision regarding the choice of delivery method. Allegro.eu indicates that at the moment this report the Order is enforceable but is not final. The Order will become final only if Allegro fails to appeal, or if the appeal is dismissed by the Court of Appeal. The interim relief will lapse if the Forum Konsumentów Foundation fails to file a lawsuit within the required deadline. Allegro.eu will provide updates on further significant stages of the proceedings through separate current reports.
