| The Board of Directors of Polkomtel Finance AB (publ) hereby informs about its accession to the Intercreditor Agreement (“Agreement") which constitutes an integral part of Finance Documentation related to Senior Secured Facility (SFA) signed on 30th June 2011 amended and restated on 6th September and 3rd November 2011. As we informed in report 21/2011 Polkomtel S.A. acceded to the SFA on 22nd December 2011. Following the accession of Polkomtel Finance AB (publ) to the Intercreditor Agreement Bondholders rights have been subordinated towards the rights of the SFA Lenders. Legal basis: § 4 of the Appendix 3 to the Bylaws of Alternative Trading System organised by BondSpot S.A. Rada Dyrektorów Polkomtel Finance AB (publ) niniejszym informuje o przystąpieniu do Umowy Pomiędzy Wierzycielami (ang "Intercreditor Agreement") ("Umowa"), która stanowi integralną część Dokumentacji Finansowej związanej z Umową Kredytową SFA ("Umowa Kredytowa") podpisaną 30 czerwca 2011 aneksowaną 6 września i 3 listopada 2011. Jak poinformowaliśmy w raporcie 21/2011 Polkomtel S.A. przystąpił do Umowy Kredytowej 22 grudnia 2011. Na skutek przystąpienia Polkomtel Finance AB (publ) do Umowy, prawa posiadaczy obligacji zostały podporządkowane wobec praw kredytodawców występujących w Umowie Kredytowej.
